These terms apply to every quotation, order and contract of sale between you and MACCAR HEALTHCARE COMPLIANCE - FZCO ("we", "us") made through this website, by e-mail or by telephone. Please read them before you order.
About us and these terms
MACCAR HEALTHCARE COMPLIANCE - FZCO is a company registered in Dubai, United Arab Emirates, trade licence available on request issued by IFZA — International Free Zone Authority, Dubai, VAT Tax Registration Number available on request. Our contact details are on the contact page.
By placing an order or accepting a quotation you agree to these terms. Our returns and refunds policy, shipping and delivery policy, warranty policy and professional-use policy form part of these terms. These terms are available in English and Arabic; if there is any difference between the two, the Arabic version prevails to the extent required by UAE law.
Nothing in these terms affects the rights you have as a consumer under Federal Law No. 15 of 2020 on Consumer Protection and its Executive Regulations, or any other mandatory law.
Who may buy
- You must be at least 18 years old and able to enter into a binding contract. If you order for an organisation, you confirm that you are authorised to do so.
- Products marked for professional use are medical devices intended for healthcare professionals and licensed facilities. They are sold under our professional-use policy, which may require a verified business account or a declaration at checkout.
- Products marked prescription required are dispatched only after we have received and approved a valid prescription.
- We may ask for documents that confirm your status (for example a trade licence or a healthcare facility or professional licence) and may decline or cancel an order if the requirements are not met. In that case any amount you have paid is refunded in full.
Product information
We describe products as accurately as possible using information from the manufacturers. Images are illustrative, and specifications may change when a manufacturer updates a model; the instructions for use (IFU) and labelling supplied with the device prevail. Registration numbers and certifications are shown only where we hold the corresponding documentation. Information on this website is not medical advice — see our medical disclaimer.
Prices and VAT
- Prices are in UAE dirhams (AED) and include VAT at 5% unless a product is shown as zero-rated or exempt. A tax invoice is issued for every order.
- If you choose to display prices in another currency, the converted amount is an approximation; you are always charged in AED.
- Delivery, installation and payment fees, where they apply, are shown before you confirm the order.
- If a price is clearly wrong because of an error, we will contact you before dispatch. You may then confirm the order at the correct price or cancel it with a full refund.
Quotations
- A quotation states the products, quantities, prices, delivery and installation terms and its validity period. Unless stated otherwise, a quotation is valid for 30 days.
- Prices in a quotation are based on the stated quantities and delivery location. Any condition — for example a lead time confirmed by the manufacturer — is written on the quotation.
- When you accept a quotation online or in writing within its validity period, it becomes an order on these terms.
Placing an order and forming the contract
- Your order is an offer to buy the products in your cart or quotation.
- We send you an e-mail acknowledging receipt. This acknowledgement does not yet mean that the order is accepted.
- The contract is formed when we confirm acceptance — by an order confirmation, by a payment confirmation for online payments, or by dispatching the products, whichever happens first.
- We may decline an order — for example if a product is unavailable, a price is wrong, or verification requirements are not met. Any payment taken is refunded in full.
Contracts concluded electronically are valid and binding under Federal Decree-Law No. 46 of 2021 on Electronic Transactions and Trust Services. We keep a record of your order and send you a copy of the order details by e-mail.
Payment
- Online card payment through our payment providers. Card details are entered on the provider's secure page and are never stored by us.
- Instalments through a buy-now-pay-later provider, where offered at checkout and subject to the provider's own terms.
- Bank transfer: your order is reserved for 3 days. If payment is not received in that time, the order may be cancelled.
- Cash or card on delivery within the UAE for orders up to AED 3,000.00; a handling fee of AED 15.00 applies.
- Pay on invoice for approved business accounts, with payment due within 30 days of the invoice date unless agreed otherwise in writing.
The payment methods available for an order are shown at checkout. If an invoice is not paid when due, we may suspend further deliveries until it is settled.
Delivery, risk and ownership
- We deliver to the address you give us, as described in our shipping and delivery policy. Delivery times are estimates; if a delay is significant we will tell you and you may cancel undelivered items for a refund.
- Equipment that needs installation is delivered by appointment. You are responsible for preparing the site (access, power, water and drainage where needed) as described in the information we send before delivery.
- Risk of loss or damage passes to you when the products are delivered to you or to a carrier you have chosen. Ownership passes when we have received full payment.
- Please check deliveries on arrival and note any visible damage on the delivery receipt. Tell us about transport damage or missing items within two days of delivery.
Returns and refunds
You may return products in the cases and within the time limits set out in our returns and refunds policy. For hygiene and patient-safety reasons some products cannot be returned once opened. Your rights for faulty or incorrectly described products are not affected.
Warranty
Products are covered by the manufacturer's warranty for the period stated on the product page, or 12 months from delivery if no period is stated, as set out in our warranty policy. The warranty does not cover consumables, normal wear, damage caused by misuse, incorrect installation by others, unsuitable utilities, or repairs by unauthorised persons.
Your responsibilities when using medical devices
You are responsible for using products in accordance with the manufacturer's instructions for use, by appropriately trained and qualified personnel, and for meeting the licensing requirements that apply to your facility and practice. Clinical decisions remain the responsibility of the treating healthcare professional.
Liability
- Nothing in these terms excludes or limits any liability that cannot be excluded or limited under the laws of the UAE, including liability for fraud or for harm caused by gross negligence.
- Subject to that, our total liability for any claim relating to an order is limited to the price paid for the products concerned.
- To the extent permitted by law, we are not liable for indirect or consequential losses such as loss of profit, loss of revenue or business interruption.
Events outside our control
We are not responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, epidemics, war, government action, port or airport closures, manufacturer supply interruptions or carrier disruptions. We will inform you as soon as possible. If such an event lasts more than 30 days, either of us may cancel the affected part of the order, and we will refund anything paid for products not delivered.

We process personal data as described in our privacy policy.
Governing law and disputes
These terms and every contract made under them are governed by the federal laws of the United Arab Emirates and the laws of the Emirate of Dubai. The courts of the Emirate of Dubai have exclusive jurisdiction, without affecting any mandatory right you have as a consumer to bring a claim elsewhere or to complain to the competent consumer protection authority, such as the Department of Economy and Tourism in Dubai or the Ministry of Economy.
If you have a complaint, please contact us first — most issues can be solved quickly.
Changes to these terms
We may update these terms from time to time. The version published when you place an order or accept a quotation applies to that order.
